ROLE SUMMARY


The National Legal Recovery Manager will lead legal recovery operations across India and drive end-to-end recovery actions under SARFAESI, Section 138 of the Negotiable Instruments Act, Arbitration proceedings, and Execution Petitions (EP) for decree enforcement. The role requires strong litigation oversight, legal vendor management, and close coordination with collections teams to maximize recovery from NPA and overdue accounts.


Role will be responsible for developing and implementing effective legal recovery strategies. Empanelment of legal vendors and enforcement agencies.

KEY RESPONSIBILITIES

 

Legal Recovery & Enforcement Strategy

  • Classify NPA accounts for legal recovery through SARFAESI, Arbitration, Section 138 proceedings, Civil/Criminal actions, or Execution Petitions based on exposure and case profile.
  • Develop and implement legal recovery strategies aligned with collection and resolution objectives.
  • Drive faster legal closures and cost-effective recovery outcomes across portfolios.
  • Manage and monitor SARFAESI portfolio worth approximately ?465-470 Crore and Arbitration/Section 25 portfolio worth approximately ?195 Crore.

Team Management

Managing the State legal recovery Managers. Providing guidance, training, and development opportunities to ensure effective legal recovery operations.

Case & Litigation Management

Oversee the management of legal cases, including reviewing and analyzing case files, developing case strategies, and ensuring timely and effective case resolution. Manage litigation efforts, including working with external counsel, reviewing and responding to legal documents, and ensuring compliance with court procedures.

Manage litigation matters across: 

    • DRT
    • Civil Courts
    • Criminal Courts
    • Section 138 (Cheque Bounce / NACH Bounce)
    • Fraud-related cases
    • Arbitration proceedings
    • Execution Petitions (Post-Award Enforcement)

Oversee arbitration filings, interim applications, awards, and subsequent enforcement actions.

Monitor case milestones, interim orders, legal risks, and closure timelines.

Ensure effective representation through legal counsel across forums.

Recovery Operations

Oversee recovery, develop recovery strategies, and ensure effective recovery of dues through executing warrants.

Compliance & Governance

Ensure compliance with regulatory requirements

    • SARFAESI Act
    • Negotiable Instruments Act
    • Arbitration & Conciliation Act
    • Civil Procedure Code (CPC)
    • RBI and NHB guidelines

Handle audit observations, regulatory reviews, and legal compliance requirements.

Maintain legal governance and portfolio hygiene across all regions.

SARFAESI Management

  • Oversee issuance and execution of SARFAESI notices including Sections 13(2) and 13(4).
  • Drive symbolic possession, physical possession, valuation, and e-auction processes.
  • Coordinate with Authorized Officers, field teams, valuers, and empanelled advocates for effective execution.
  • Ensure compliance and timely progress of all SARFAESI actions.

Vendor & Advocate Management

  • Empanel, monitor, and evaluate advocates, legal firms, and recovery agencies across India.
  • Establish performance benchmarks and compliance standards.
  • Standardize legal notices, recovery documentation, and litigation processes.
  • Ensure adherence to agreed service-level standards and recovery objectives.

MIS & Reporting

  • Prepare and maintain comprehensive MIS covering: 
    • SARFAESI cases
    • Section 138 cases
    • Arbitration matters
    • Execution Petitions
    • Legal expenses and recovery performance
  • Present periodic dashboards and recovery updates to senior management.
  • Identify bottlenecks and recommend corrective action plans.

KEY SKILLS & BEHAVIOURAL ATTRIBUTES 

  • Legal Knowledge in Arbitration, SARFAESI, Civil and Criminal case updation and Sec.138 of NI Act, Sec.25 of Payment and Settlement Acts with latest updates. 
  • Having court practice knowledge

EDUCATION / EXPERIENCE

Minimum Qualification: Law Graduate


Nature of Experience: 10-15 of experience in legal recovery, litigation, or a related field, with a focus on LAP or mortgage finance
